Your best bet would be to write a letter of apology to the land owner. Tell him you are sincerely sorry for causing him/her any distress. You will not proceed on the land any more and hope he understands it was purely an accident you believed you were well of his property line. Leave your phone number so he can contact you if he wishes. Also have a plant delivered for the inconvience.

Thats what I would do.

Then when you go to court show a copy of the letter to the judge and most likely he will drop the charges.

Technically you were trespassing either way, either the owners property or the power company.

So take your fine and learn your lesson.

I agree with lucky, no innocence in this case.

You're lucky plain and simple. Pay the fine and chalk it up to lesson learned.

In the big scheme of things, some people think that those who ride ATV’s are trouble. A few bad apples spoiled the whole basket.

I also ride a Sport Bike and a majority of the guys that I hang with obey the rules. The others are the ones that stunt ride and do all the crap you see and read about in the news. When I’m riding solo I’ve come across all kinds of behavior that makes you want to stop riding all together.

Also where I live someone got so pissed at the ATV’s that they strung cable across the trail and the kid was decapitated. It’s still in the courts as to who was in the wrong, but two wrongs don’t make a right.

Holy crap are you kidding me? That didn't happen did it?

That guy should get the death penalty.

is this hondaforeman.com or ur wrongforrideing.com. the man was riding ,no harm done.certain ones make it look like that he had no reason to even sit on his atv. so why did he even buy it.why do yall have one.and why r u guys members of this web site.poeplle should stand w/ the guy as brothers of the sport. thats about him ,now about me! ive been riding since the early 80's and yes i have had my run-ins w/ people.even been chased and ramed.so now if someone acks like they got a probem w/ me rideing. i stop and listen to what they have to say for just a breif moment.i dont give them no info and just say im sorry and move on.BUT if the person whats to run their mouth out of the way, touch me or my atv, that just means a ass whoopin on the spot.then they have good reason to call the law but at least i got mine.sorry but thats just how i feel about ridin.and nobody will stop me from ridin, i just wont go the way again. i heard about the cable deal years ago.if he didnt hang red flags of some sort on the cable then that means his intentions was to hurt somebody thats doing nothing wrong, just riding his atv.other atv riders ride on my little bit of land and if im out there when the come threw, i just give them a thumb up and they wave back and if its late, they ride threw slowly and quite as possable.thats the respect we have for each other here in rocky mount north carolina. like it or not

The map won't do you much good. All the guy has to say is that you crossed onto his property. The police obviously investigated this and determined that you had tresspassed. Therefore, you also have to dispute the police investigation as well. Frankly, because you rode through a stream, you're luckly the local DNR wasn't involved as well. Bottom line is that you have to respect other peoples propety and you obviously didn't.

It's happened before and it will happen again. Usually what happens is that both parties are cited. One for tresspassing and the other for some sort of criminal reclessness. The bottom line is that you can't create a hazzard that has the intent of injuring another person. It doesn't matter if this hazzard is in the middle of your property or inside your home. Boobie traps are illegal.

Was ridding last monday night with some buddies. We rode down this major power line(concrete poles not wood) got into a creek and rode under this road through a 8' tall culvert and had to winch up the embankment. Cops came and said that this guy has a house that sits off on the power line( which you can see) said we rode through his "front yard". Did not really think that it was going to go this far, but I got served today. HERE IS WHERE I NEED HELP!! Where can I get a copy of land ownership that shows property boundaries or is there such a thing without me having to have a survey I am trying to prove it is not his property we were on or if we were I can take the fine. I am just fed up with people trying to ruin innocent fun!! NOW THE BAD He does have no trespassing signs, but it was dark and they couldn't be seen, I know that argument will not hold so I am trying to prove no ownership. Obviously the only one that has a right-of-way is the power company. Any ideas would be great or how some have gotten out off it besides running from the cops.

Hi I'm new my name is Sherry -but just an fyi, we were riding in the mtns up in idaho and ran across a long time rider that rides everywhere. He was telling us there is a law it is either 1816 -1849 somewhere in there but it states ( and its a very old law ) THAT CLAMS WE ARE ALLOWED TO RIDE PRACTICALLY ANYWHERE. ( within reason of course, out side city limits - you know what I mean ) I have not looked up this law yet, but he was telling us if we should ever get a ticket, you are to mention this number to the judge and it gets thrown out everytime. He claims proven fact.

sherry

I know down here in AZ there are plenty of laws still on the books
from the 19th & 20th century that are yes still laws but are kinda
confusing by today's political correctness

In fact here are a couple

Donkeys cannot sleep in bathtubs.

In Mohave County
A decree declares that anyone caught stealing soap must wash himself with it until it is all used up.

And in Tombstone,
It is illegal for men and women over the age of 18 to have less than one missing tooth visible when smiling.

A great portion of AZ is BLM & State Trust Land with private land around it.

As always know where your riding and leave a positive note that the ATV/OHV
community is respectful of everyone

Again Welcome !
